By visiting our website and/or purchasing something from us, you agree to be bound by these Terms of Service, together with our Shipping Policy, Return & Refund Policy, Privacy Policy, and any other policies published on this website.

1. ONLINE STORE TERMS

By using this website, you confirm that you are at least the age of majority in your country or region of residence, or that you have permission from a parent or legal guardian where required by law.

You may not use our website, services, or products for any illegal, unauthorised, or prohibited purpose. You must not violate any applicable laws, regulations, or third-party rights when using our website.

BYAG.DE offers apparel, accessories, beauty, skincare, cosmetics, and other lifestyle products.

Some products may be produced, packed, and shipped through trusted fulfilment partners. Different product categories may be fulfilled by different partners.

All products are subject to availability. We reserve the right to modify, discontinue, limit, or remove any product at any time without prior notice.

We make every effort to display product images, colours, textures, sizes, descriptions, and details as accurately as possible. However, we cannot guarantee that your device display will show colours or details exactly as they appear in real life.

Minor differences in colour, fit, packaging, print placement, texture, or product appearance may occur due to production processes, screen settings, product batches, supplier updates, or packaging changes.

3. PRODUCT INFORMATION

We aim to provide accurate product information, including descriptions, materials, ingredients, usage instructions, sizes, and care guidance where applicable.

For beauty, skincare, cosmetics, and hygiene-sensitive products, customers should always check the product information, ingredients, warnings, and usage instructions before use.

BYAG.DE is not responsible for improper use of products, failure to follow product instructions, or reactions caused by individual sensitivities, except where liability cannot be excluded by law.

4. PRICES AND PAYMENT

All prices are shown in the currency displayed at checkout.

We reserve the right to change prices, discounts, promotions, product availability, and shipping costs at any time without prior notice.

The final price, including applicable taxes and shipping costs, will be shown at checkout before you place your order.

Payment must be received in full before an order is processed, produced, packed, or shipped.

5. ORDER ACCEPTANCE

After placing an order, you will receive an order confirmation email. This email confirms that we have received your order, but it does not automatically guarantee final acceptance of the order.

We reserve the right to refuse, cancel, or limit any order where legally permitted, including in cases of:

- suspected fraud or unauthorised activity
- pricing or product information errors
- technical errors
- unavailable products
- fulfilment or production issues
- incorrect or incomplete customer information
- misuse of promotions, discounts, or the website

If we cancel an order after payment has been made, we will refund the amount paid for the cancelled item(s), unless another lawful solution applies.

6. FULFILMENT PARTNERS AND SEPARATE SHIPMENTS

BYAG.DE works with trusted fulfilment partners for production, packing, and shipping.

If your order contains products from different categories, such as apparel and beauty products, your items may be shipped separately and may arrive on different dates.

Separate shipments do not mean that your order has been duplicated.

Shipping times, tracking details, return addresses, and return instructions may differ depending on the product category and fulfilment partner.

Please do not return any item to the address printed on the parcel or directly to a fulfilment partner unless we have specifically instructed you to do so.

7. SHIPPING AND DELIVERY

Shipping and delivery information is provided in our Shipping Policy.

Delivery times shown on the website, at checkout, or in order confirmation emails are estimates only, unless expressly stated otherwise.

Delays may occur due to production times, high order volume, carrier issues, public holidays, customs procedures, incorrect shipping information, or other circumstances outside our direct control.

Your statutory consumer rights remain unaffected.

8. RETURNS, WITHDRAWAL, AND REFUNDS

Your right to return products, withdraw from your order, and receive refunds is governed by our Return & Refund Policy.

If you are a consumer in the European Union, you may have a legal right of withdrawal within 14 days of receiving your order, subject to applicable exceptions.

For hygiene and health protection reasons, opened, unsealed, used, or tested beauty, skincare, cosmetics, and personal care products may not be eligible for return, unless the item is faulty, damaged, or incorrect.

Personalised or customer-specific products may also be excluded from return where allowed by law.

Your statutory rights remain unaffected.

9. STATUTORY WARRANTY

Consumers are entitled to statutory rights for defective or non-conforming goods under applicable law.

If an item is faulty, damaged, incorrect, or does not conform to the contract, please contact us as soon as possible at info@byag.de and include your order number and clear photos of the issue.

Nothing in these Terms limits your mandatory statutory rights.

10. EXCHANGES

We do not offer direct exchanges.

If you would like a different size, colour, or product, please return the original item in accordance with our Return & Refund Policy and place a new order.

11. PROMOTIONS, DISCOUNTS, AND GIFT CARDS

Promotions, discounts, and discount codes may be subject to additional conditions.

Discount codes must be used before completing checkout and cannot usually be applied retroactively after an order has been placed.

We reserve the right to modify, suspend, or cancel promotions where legally permitted, including in cases of misuse, technical errors, or incorrect application.

Gift cards, where offered, may be subject to separate terms.

12. ACCURACY OF BILLING AND ACCOUNT INFORMATION

You agree to provide complete, accurate, and current billing, shipping, and contact information.

BYAG.DE is not responsible for delays, failed deliveries, or additional costs caused by incorrect or incomplete information provided by the customer.

If your information changes after placing an order, please contact us as soon as possible. We cannot guarantee that changes can be made once an order has entered processing, production, or fulfilment.

13. INTELLECTUAL PROPERTY

All content on this website, including text, graphics, logos, images, product descriptions, branding, designs, layouts, photos, videos, and other materials, is the property of BYAG.DE / Asen Georgiev or its licensors.

You may not copy, reproduce, distribute, modify, publish, exploit, scrape, or use any website content for commercial purposes without our prior written permission.

The BYAG.DE name, branding, logos, product concepts, and design elements may not be used without authorisation.

Your statutory consumer rights remain unaffected.

19. GOVERNING LAW

These Terms are governed by the laws of Germany.

If you are a consumer, this choice of law does not affect any mandatory consumer protection rights that may apply in your country of residence.

20. CONSUMER DISPUTE RESOLUTION

We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

21. CHANGES TO THESE TERMS

We reserve the right to update, modify, or replace these Terms of Service at any time.

The version published on this website at the time of your order will apply to that order, unless mandatory law requires otherwise.
